Overview

Our lawyers handle all forms of land use litigation.

We appear before local planning committees and municipal boards to gain entitlements, avoid litigation, or create the necessary record to preserve claims in the courts. We represent developers, banks, businesses, industry associations, and property owners. Given our extensive municipal law experience, we also advise local governments on annexations, intergovernmental agreements, cooperative boundary agreements, and challenges to zoning regulations.

 

Members of Michael Best’s Land Use Litigation practice have experience in complex commercial real estate development projects, public-private partnerships, sales and acquisitions, leasing, construction, land use and entitlement approvals, and the formation of commercial and residential condominiums. We often collaborate with members of the firm’s project development and financing practices, among others.

Our land use litigation experience includes permitting and zoning, land use planning, easements, nuisance, tax assessment challenges, condemnation actions, leasing disputes, entitlement, non-conforming uses, foreclosures, and other actions affecting the use of real property.
