Opportunity to Seek a Clean Air Act Section 112 NESHAP Presidential Exemption

Section 112(i)(4) of the Clean Air Act allows the President to exempt stationary sources of air pollution from compliance with any section 112 standard for up to two years if the necessary technology is unavailable and it is in the national security interests. The exemption can be extended for up to two more years if needed.

The EPA flagged sources in nine industry categories that might apply for such an exemption due to ongoing reconsideration of their respective NESHAPs and concerns with national security.  The application deadline is Monday, March 31, 2025, so sources must act quickly. The application must explain why the technology to implement the standard is not available and why an extension is in the national security interests of the United States.
