OverviewAnne is experienced in all stages of litigation in both state and federal courts. Clients rely on her responsiveness and dedication in a wide variety of matters, including business litigation, securities litigation, employer/employee disputes, and property disputes, as well as trade secret, product liability, personal injury, and construction defect cases. ExperienceAnne most frequently represents clients in business disputes, including breach of contract, misappropriation of trade secrets, shareholder disputes, and construction cases. Anne defends Broker-Dealers, Registered Representatives, and Investment Advisers in FINRA customer- and industry-arbitrations and expungements, as well as FINRA and SEC regulatory investigations and disciplinary actions. Anne also defends accounting firms in PCAOB, SEC, and State regulatory investigations and disciplinary proceedings. Anne represents employers in administrative proceedings and litigation brought by employees/former employees in both Utah and Nevada. Anne also advises and represents Amazon Delivery Service Providers (DSPs) and other delivery and logistics companies in a variety of matters common to the industry. Anne’s notable matters include:
- Part of a team of attorneys that obtained a defense verdict from the jury in a personal injury case where the plaintiff alleged several million dollars in damages. The team also went on to appeal the lower court’s previous $1 million award against its client based on a contractual indemnity provision, and obtained a reversal from the state supreme court.
- Obtained a favorable jury verdict for Plaintiff in personal injury case.
- Defended a broker-dealer against a multi-million dollar claim and obtained a zero damages award after a two-week FINRA arbitration.
- Obtained early dismissal of all claims in discrimination suit brought by former employee, arguing for statutory interpretation not yet addressed by supreme court. Affirmed on appeal to state supreme court. Kimbrough v. Round Mountain Gold Corp., Nevada Supreme Court Case No. 86252
- Secured early dismissal of all but one claim by motion in FINRA customer-initiated arbitration, with the remaining claim withdrawn.
- Obtained a quick and favorable trial verdict on behalf of an employer in a contractual dispute related to stock awards.
