With over 20 years of experience, Duncan is a distinguished professional in the fields of intellectual property, data privacy, and regulatory compliance. As a registered patent attorney with the US Patent & Trademark Office and certified data privacy professional (CIPP/US), Duncan is exceptionally positioned to address evolving legal landscapes impacting intellectual property both domestically and internationally.

Currently serving as Vice-Chair of the ABA’s IP Transactions & Licensing Committee, Duncan has developed profound expertise in drafting and negotiating complex agreements, including licenses for cloud services, SaaS, patents, trademarks, trade secrets, open-source software, font software, resellers, professional services, AI services, and joint development projects. Duncan partners with clients to provide practical solutions for complying with evolving international laws, including laws in the area of data privacy, data security, and AI governance.

Before joining Michael Best, Duncan spent 12 years in-house as Senior Corporate Counsel for iHeartMedia, where he led negotiations to integrate iHeartRadio’s digital streaming services and logos onto platforms across numerous industries, including gaming software, virtual reality headsets, smart TVs, social media platforms, automobile entertainment systems, and mobile devices. Duncan also managed agreements for content inclusion on platforms, content licensing, podcasting, vendor relationships, and digital advertising, incorporating essential data privacy and security provisions. In addition, Duncan directed the company’s patent prosecution, procurement and litigation strategy, ensuring robust protection and enforcement of intellectual property rights. Prior to this in-house role, Duncan was an associate at several prominent law firms in Washington, D.C., specializing in intellectual property litigation, patent prosecution, and IP portfolio management.

Before becoming an attorney, Duncan was an officer in the U.S. Navy serving as a Nuclear Propulsion Plant Watch Officer and Officer of the Deck onboard an aircraft carrier, as well as an instructor of Thermodynamics at the U.S. Naval Academy.
