Overview

Luis represents employers in a range of labor and employment matters and has developed a significant practice focusing on employee defection and recruitment, including litigating injunction and damage actions relating to: covenants not to compete, non-solicitation and non-disclosure agreements, unfair competition, trade secrets, duty of loyalty, the Computer Fraud & Abuse Act, and state trade secrets and unfair competition statutes. 

Luis has represented clients in numerous industries including banking and securities brokerage, print media, software, medicine, automotive parts manufacturing, construction, commercial chemical, trucking, and industrial HVAC. In addition to litigating, he provides training to companies on such litigation, ways to avoid or succeed in such litigation, and assists clients with the drafting of non-compete agreements to meet the specific needs of their industry and state law. Luis also helps clients develop programs to protect competitive assets against employee defection, and to minimize risks when hiring from competitors.

Luis' practice also includes traditional employment and labor cases, for both public and private sector clients regarding race, age, sex, national origin, disability claims, worker’s compensation claims, and unemployment compensation matters. He served as a Judicial Intern to Judge Jon P. Wilcox at the Wisconsin Supreme Court during law school at the University of Wisconsin-Madison.

Experience

Trade Secret/Non-Compete Litigation

  • Successfully obtained injunctive relief, judgments, and favorable settlements for national trucking company involving former employee dispatcher/broker violations of non-compete agreements in multiple states
  • Successfully obtained injunctive relief and favorable settlement involving in trade secret claims against defecting employees in medical services industry
  • Successfully defended a national OEM/Tier 1 automobile parts manufacturing company from injunctive relief prohibiting the employment of a high-level sales manager in connection with an alleged breach of a non-compete agreement and alleged theft of trade secrets
  • Part of the team that obtained monetary judgment and injunctive relief prohibiting competitive activities against a former employee broker-dealer in connection with theft of trade secrets and violation of non-compete agreement when employee joined a national FINRA-member brokerage firm
  • Part of the team that successfully defended preliminary injunction in a breach of non-compete action initiated by a regional sales employee to a competitor media conglomerate
  • Part of the team that successfully defended a regional insulation installment company from a temporary restraining order in a complaint alleging breaches of multiple non-competition agreements and trade secret theft in connection with the hiring of multiple sales employees of a competitor
  • Part of the team to obtain injunctive relief and monetary settlement on behalf of a global climate control manufacturing company in connection with a defecting employee’s theft of trade secrets

  • Village of Twin Lakes and Twin Lakes Police Officers Association; Decision No. 69204 (2011) (Grievance arbitration involving Police Chief’s authority to define scheduling assignments for new officers recently off probation.) 
  • Town of Bristol and Labor Association of Wisconsin; Decision No. A/P M-09-172 (2010) (Grievance arbitration regarding the termination of an employee for failing to participate in mandatory fire department training.)
  • Village of Twin Lakes and the Twin Lakes Dispatchers Association; Decision No. 69205 (2010) (Grievance arbitration involving the authority of a Police Chief to unilaterally implement vacation scheduling procedures for dispatchers in light of the needs of the department and management rights.)
