Overview

Michael uses his background in mechanical and civil engineering to manage complex patent litigation matters. A registered patent attorney, he represents technology companies in a broad range of industries, including biotechnology, pharmaceutical, life sciences, medical devices, consumer products, manufacturing, software and digital media, entertainment, sports, and gaming. Michael also helps clients navigate disputes related to their trademark, copyright, and trade secret rights.

Additionally, Michael also advises companies in various commercial litigation matters. His experience extends to all stages of litigation, including due diligence, initial case assessment, client counseling, discovery, mediation, arbitration, summary judgment, trial, and appeals.

Prior to joining Michael Best, Michael was an Associate with an AmLaw 50 law firm.  Before becoming an attorney, he spent several years as a bridge engineer for the world’s largest engineering design firm, gaining valuable industry experience that informs his counsel to clients.

Experience

Michael has represented clients in the following matters:

  • Obtained a jury verdict of contributory and induced infringement and no invalidity on behalf of a water services corporation. After a two-week trial, the jury awarded more than $7.5 million in royalties to the client after finding the adverse party had infringed two of the client’s patents.
  • Represented a pharmaceutical company in a district court trial resulting in a finding that the patent covering a multiple sclerosis treatment was invalid for lack of written description, allowing the client to market the first generic version of the drug.
  • Represented multiple global pharmaceutical companies, brand and generic, in Hatch-Waxman litigation related to infringement of compound, formulation, method-of-treatment, and medical device patents.
  • Successfully represented sports equipment companies in patent infringement cases directed to football helmet and baseball bat technologies.
  • Represented an industrial manufacturer on appeal in a contract dispute over the sale of its fiberglass window intellectual property.
  • Represented a healthcare information technology start-up company in a securities dispute during its venture capital funding.
