EventThe ethical duty of technology competence is now effective in forty states across the United States. The duty requires that attorneys be competent with the benefits and risks of technology. For in-house and outside counsel alike, this raises the standard of care in the context of giving advice and direction about how businesses establish and maintain a “reasonable security programs, implement “privacy by design” in their business operations, and evaluate the risks to data subjects associated with the processing of their personal data. Compliance programs aren’t the only place where technical competence is needed – understanding how the underlying technology operates is increasingly critical for attorneys when drafting and negotiating technology agreements.
