Coming off substantial verdicts and settlements arising out of the opioid crisis, recent reports indicate that veterinary drug diversion is beginning to worsen the emerging fentanyl crisis. We intend to present the history of the fentanyl crisis and the problems it poses for the veterinary pharmaceutical, including prescribers. We intend to discuss the legal environment of veterinary drugs, professional obligations of veterinary professionals for prescriptions, including as it relates to the VCPR and telemedicine, and the legal trends that could impact the industry by looking at lessons learned from the opioid crisis and reviewing the legal obligations and risks presented to the veterinary industry arising from drug diversion and, more specifically, as they relate to the fentanyl crisis while presenting lessons that, if learned, can protect the industry from the same kinds of liability suffered by human pharmaceutical companies, pharmacies, and prescribers arising out of the opioid crisis.
